OVERVIEW The U.S. Securities and Exchange Commission adopted the Conflict Minerals 13p-1 ruling in August 2012. For the last 3+ years, public companies have filed a “Form SD” with their annual filings documenting their adherence to declaring whether or not their products contain tin, tantalum, tungsten, or gold sourced from the Democratic Republic of Congo – a war torn region. More devastating is the linkage between sourcing from war torn regions and the potential for forced labor, human trafficking, and slavery. Migrant labor is often targeted by brokers who restrict freedom of movement, collect exorbitant fees, withhold earnings and visas, and in some regions sell workers into slavery. The United States and the European Union regulate supply chain activities and demand accountability from all who do business in these regions.
